James Everett Dutschke is a former intelligence turned political operative who some believe was involved in several notable controversial affairs including the 2013 ricin attacks against a US Senator and US President Obama [2]
Special Prosecution and Conviction - Developing a Biological Weapon
In 2013, the FBI claimed that President Obama, Senator Roger Wicker and a Mississippi judge were targeted using ricin-laced letters. The original suspect (an anti-CIA, anti-government conspiracy theorist named Paul Kevin Curtis) was arrested but then later released after denying any knowledge whatsoever of any assassination plot, yet still publicly blamed Dutschke. The released suspect, Curtis, had also previously publicly blamed Dutschke as being a cover-up agent for a separate conspiratorial claim, voicing frustration with Dutschke, US Senator Roger Wicker and President Obama for failing to listen to him. Dutschke was then accused by the Obama Administration of developing the claimed deadly chemical weapon of assassination, ricin, and arrested. Using a rare, special presidential power invoking national security called a SAM Order (28 CFR 501 .2/.3), the Obama Administration's Attorney General, Eric Holder, and the National Security Division of the Department of Justice prosecuted Dutschke under that SAM of violating the international treaty against the development of biological weapons, while silencing Dutschke and his attorney from any and all contact and communication with any person, including the press. The special SAM prosecution is considered controversial, in part, because the executive order (SAM) prevented all communication by or on Dutschke’s behalf [12] and the reported product of the case (ricin) is legally explicitly defined as a Chemical Weapon (by treaty, statute and regulation) and is NOT a biological weapon (CWCIA) [11]. No reasonable explanation has ever been given as to why the wrong statute, enforcing an entirely different treaty, was allowed in court in the high-profile, controversial case.
Despite Dutschke’s continued insistence of innocence and the denial of due process, he was convicted in May, 2014 (via a legal mechanism called an Alford Plea) of Developing a Biological Weapon, then sent to the specialized National Security Unit inside the USADX Supermax prison and disallowed any communication [5] [6] [7].
Leaked and discovered documentary evidence [8] since the 2014 SAM conviction have revealed that the Mueller(2013)/Comey(2014) FBI (who both endorsed the national security SAM order) knew prior to the Dutschke indictment(s) that their primary and public claim of Dutschke’s DNA and traces of ricin on a "discovered" dust mask, as well as the original claim of three ricin-laced envelopes [10] were false claims [9].
Nevertheless, Dutschke remained sentenced to 25 years for Developing a Biological Weapon [2] [5] [7] [8]
